Terms of Service — Vidre App

1. About These Terms

These Terms of Service ("Terms") govern your use of the Vidre mobile application ("the App").

The App is provided by:

("we", "us", "the Club")

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read together with our Privacy Policy.

2. What the App Is

The App is an internal tool for members and course participants of Ronilački klub Vidre. It allows you to:

  • book places on organised dives, pool sessions and courses
  • view schedules and receive notifications about changes
  • communicate with instructors and other members
  • maintain a record of your participation in club activities

The App is not a dive planning tool, a dive computer, or a safety device. It does not calculate decompression, monitor gas consumption, or provide any information relevant to the safety of a dive. See Section 6.

The App contains no payments, purchases or subscriptions. Membership fees and course payments are handled separately, outside the App.

3. Eligibility and Accounts

Age. You must be at least 15 years old to create an account on your own. Users under 15 may have an account created only with the written consent of a parent or legal guardian, obtained by the Club as part of the enrolment process.

Membership. The App is available only to members and course participants of the Club, as well as joint participants. We may decline or revoke access for anyone who is not.

Your account. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly at divingcentervidre@gmail.com if you believe your account has been accessed by someone else. You are responsible for activity carried out through your account.

Deleting your account. You may delete your account at any time in the App, via Settings → Account → Delete Account. Deletion is handled as described in our Privacy Policy.

4. Bookings

A booking is a reservation, not a guarantee. Dives and sessions depend on weather, water conditions, equipment availability, group size and instructor judgement. We may cancel, reschedule or modify any activity at any time, including at short notice, where we consider it necessary.

Cancelling. If you cannot attend an activity you have booked, cancel it in the App as early as possible. Places are limited and late cancellations prevent other members from taking your place. Repeated failure to attend booked activities without cancelling may result in restricted access to bookings.

Eligibility for an activity. Booking a place does not confirm that you are qualified for that activity. Instructors and dive leaders decide, on site, whether a participant may take part, based on certification level, recent experience, physical condition and conditions on the day. Their decision is final.

Accuracy of your details. You are responsible for ensuring that the certification level and diving experience recorded in your account are accurate and current. Incorrect information may put you and others at risk.

5. Acceptable Use

When using the App, you agree not to:

  • use it for anything other than Club activities
  • share your account with anyone else
  • post or send content that is unlawful, abusive, harassing, discriminatory or otherwise inappropriate
  • share other members' personal data outside the App without their consent
  • attempt to gain unauthorised access to the App, other accounts, or our systems
  • interfere with the operation of the App, or use automated means to access it
  • copy, reverse-engineer, decompile or create derivative works from the App

We may suspend or terminate access for any user who breaches these Terms.

6. Diving Safety — Important

Scuba diving carries inherent risks, including serious injury and death. Your safety depends on your training, your equipment, your buddy, your physical condition, the conditions on the day, and the procedures you follow in the water. It does not depend on this App.

You acknowledge and agree that:

  • the App does not replace any part of standard diving safety practice, including dive planning, pre-dive checks, buddy checks, gas management, or the use of a dive computer
  • information shown in the App (schedules, locations, times) is for organisational purposes only and must never be relied on as safety-critical information
  • notifications may be delayed, undelivered, or missed for reasons outside our control, including device settings, connectivity and third-party service failures — never rely on the App alone to know whether an activity is going ahead
  • you are responsible for diving within the limits of your certification, training and recent experience
  • you are responsible for informing your instructor or dive leader of any change in your health, medication or fitness to dive
  • participation in Club activities is subject to the Club's separate waivers, medical declarations and safety briefings, which take precedence over anything shown in the App

If in doubt about an activity, contact the Club directly by phone rather than relying on the App.

7. Communication Between Members

The App includes features that allow members to communicate with each other and with instructors.

Messages sent through the App are visible to their recipients and may be visible to Club administrators where necessary for the operation and safety of Club activities. Do not use the App to send confidential or sensitive personal information.

We do not routinely monitor communications, but we may review them where we have reason to believe these Terms have been breached, or where required to protect the safety of members.

8. Availability

We aim to keep the App working, but we provide it "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or available at any particular time.

We may modify, suspend or discontinue the App, or any of its features, at any time. Where a change materially affects you, we will give notice through the App where reasonably practicable.

The App depends on third-party services (Firebase, Expo, your device's operating system and your network connection). We are not responsible for failures originating with those services.

9. Intellectual Property

The App, its design, content and the Vidre name and logo belong to the Club or its licensors. These Terms grant you a limited, personal, non-transferable, revocable licence to use the App for Club purposes only. No other rights are granted.

10. Limitation of Liability

To the extent permitted by Serbian law:

  • we are not liable for indirect or consequential loss arising from your use of the App
  • we are not liable for loss arising from your inability to access the App, from missed or delayed notifications, or from failures of third-party services
  • nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited

Nothing in this Section limits our responsibilities as a diving service provider. Our obligations in relation to the conduct of dives, instruction and supervision are governed by the applicable law and by our separate agreements, waivers and the standards of SDI, TDI and ERDI — not by these Terms, which concern the App only.

11. Suspension and Termination

We may suspend or terminate your access to the App if you breach these Terms, if your Club membership ends, or if we discontinue the App.

You may stop using the App and delete your account at any time.

Sections 9, 10 and 13 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted at this address with an updated date. For material changes, we will notify you through the App before they take effect. Continuing to use the App after changes take effect means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any dispute arising from them falls under the jurisdiction of the competent courts in Belgrade, Serbia.

Nothing in these Terms affects your rights as a consumer under mandatory provisions of Serbian law.

14. Apple App Store

The following applies where you obtained the App from the Apple App Store:

  • these Terms are between you and the Club only, not with Apple, and the Club alone is responsible for the App and its content
  • Apple has no obligation to provide any maintenance or support for the App
  • in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App
  • the Club, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection or similar legislation
  • the Club, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes intellectual property rights
  • you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you
